Doc Kyiv Fest Rules & Regulations

Doc Kyiv Fest is a film festival created to support and develop the cinematic art and film industry in Ukraine, as well as to present Ukrainian and world medium-length documentary films of high artistic quality to the audience (hereinafter referred to as the Film Festival).

The founder and organizer of the Film Festival is the Public Organization “Kinofest” (hereinafter referred to as the Organizer), a legal entity registered and operating in accordance with the current legislation of Ukraine. The Film Festival is held in Kyiv (Ukraine) on the basis of these Regulations. The Film Festival is scheduled to take place from March 28, 2024 to March 30, 2024.

The Film Festival program consists of three sections:

  • National competition program of medium-length documentaries
  • Special screenings of Ukrainian medium-length documentaries
  • Special screenings of foreign medium-length documentaries

I. DEFINITIONS

For these Regulations, the following terms and definitions are applied:

– Mid-length Film: a type of film with a duration of 20 to 70 minutes;

– Ukrainian Film: an audiovisual work of cinematography, consisting of episodes united by a creative concept and visual means, the production of which is entirely or partially carried out in Ukraine or within the framework of international co-production (joint production) with Ukraine.

– Foreign Film: an audiovisual work of cinematography, consisting of episodes united by a creative concept and visual means, the production of which is entirely or partially carried out in countries other than Ukraine.

II. COMPETITIVE PROGRAMS

2.1. Participation in the competitive programs of the Festival

2.1.1. Applications for participation in the Festival’s competitive programs are accepted from any legal or physical persons who have reached the age of 18, regardless of citizenship and place of residence (stay), subject to the requirements of the current legislation of Ukraine. The Festival will not accept films created on behalf of organizations or to reflect their activities, projects with a pronounced propaganda direction supporting political, personal, or commercial interests, as well as instructional and educational films. Films produced by the aggressor country, its citizens, or financed by persons with citizenship of the aggressor country, or permanently residing in the territory of the aggressor country, or associated with legal, physical persons supporting the armed aggression of Russia in Ukraine, as well as countries that directly support the terrorist actions of Russia, aid and/or supply weapons to the aggressor country are not eligible for consideration.

2.1.3 Films submitted to the documentary film competition program will only be considered if a digital carrier of type DCP is available.

2.2. National Competitive Program

2.2.1. Ukrainian or co-produced with Ukraine mid-length documentary (non-fiction) films, produced in 2022 or 2023, are eligible for selection in the National Competitive Program.

2.2.2. Application for participation in the National Competitive Program begins on January 3, 2024, and is free of charge. The National Competitive Program is open to Ukrainian citizens or legally residing in Ukraine participants. Participants must comply with the requirements of section 2.1.

2.2.3. To submit an application, it is necessary to fill out the online form on the festival’s official website and provide all the materials specified in the online form by 14:59:59 (Kyiv time) on January 26, 2024.

2.2.4. 6 to 10 films may be selected for participation in the National Competitive Program.

2.2.5. Films submitted for the National Competitive Program may also be selected for participation in non-competitive programs of the Festival. The person who submitted the respective application also agrees to such participation. By submitting films for participation in the Festival’s programs, the applicant guarantees the film’s participation in case of its selection and undertakes to assist the Festival in organizing the screening and inviting the participation of the creative team by providing all necessary materials, film copies, subtitles, etc.

2.2.6. The Selection Committee of the National Competitive Program, appointed by the Organizer, selects films. The Organizer approves the composition and number of members of the Selection Committee, as well as the final list of films selected for participation in the National Competitive Program, proposed by the Selection Committee. Priority will be given to films for which the screening within the National Competitive Program will be a Ukrainian premiere.

2.2.7. Information about the final list of participant films in the National Competitive Program is published on the official website of the festival, https://www.dockyivfest.com.

2.2.8. The Organizer invites the director and/or leading actors, cinematographer, and producer (up to 2 people from the listed project), and provides festival participant accreditations for no more than 5 people from one project.

2.2.9. During the Festival, winners of the National Competitive Program are determined in the following category: “Best Ukrainian Mid-length Documentary Film.”

2.2.10. Only one film participant can be named the winner in the category “Best Ukrainian Mid-length Documentary Film.”

2.2.11. The winners of the National Competitive Program in the category “Best Ukrainian Mid-length Documentary Film” are determined by the jury members of the National Competitive Program (hereinafter referred to as the National Jury), which includes leading figures in art, culture, film critics, directors, actors, producers, and other representatives of the film industry.

2.2.12. The National Competitive Program winners are announced on the festival’s last day at the closing ceremony on March 30, 2024.

2.2.13. The award for winning the National Competitive Program includes a certificate for the “Best Ukrainian Mid-length Documentary Film” and a cash prize of 50,000 UAH (fifty thousand hryvnias), which the director of the participant film receives.

2.2.14. Additionally, at its discretion, the National Jury may award no more than 2 (two) Special Diplomas of the National Jury to the participant films of the National Competitive Program or members of their creative teams.

**III. INTELLECTUAL PROPERTY RIGHTS AND GUARANTEES**

3.1. Submitting an application for participation in the Festival’s program events based on this Regulation implies that the applicant:

– Has carefully reviewed the provisions of this Regulation, including the requirements for films/projects eligible to participate in the Festival, and fully understands and accepts them;

– Confirms that they have sufficient authority to submit the application and that this action does not violate any rights and/or legitimate interests of third parties;

– Agrees to grant the Organizer the right to provide access to the film/project to the relevant juries and selection committees, and in case of successful selection, to use the film/project for public demonstration during and for the duration of the Festival.

– Guarantees that neither they nor any other physical or legal entities owning or controlling them cooperate with companies or individuals subject to any economic, trade sanctions, laws, or decrees enacted by the USA, EU, UN, Switzerland, or any other country.

– Ensures that among the ultimate beneficial owners of the companies, participants of the Project, and creative team, there are no individuals who are citizens of the Russian Federation or have a stake of 10% or more in the common budget and that there are no individuals subject to or potentially subject to sanctions as defined by the Law of Ukraine “On Sanctions”.

3.2. The applicant who submitted the application and provided materials to the Organizer under this Regulation is solely responsible for any claims, lawsuits, or other demands to them and/or the Organizer in connection with the use of these materials within the Festival, and must immediately compensate the Organizer for any possible expenses that have arisen or may arise in this regard. The Organizer has the right to exclude the film from participation in the Festival, if evidence of infringement of copyright and/or other rights of third parties by the applicant is obtained.

3.3. The Organizer guarantees that they will not use the audiovisual works and other materials of individuals who have submitted applications according to this Regulation in ways not provided for by this Regulation.

3.4. The Organizer ensures the correct technical presentation of the film. The Organizer is obligated to prevent piracy, illegal reproduction, and distribution of all officially submitted films within the National Competitive Program, which are objects of copyright of participants (right holders).

3.5 The Organizer does not make any payments for the right to show films selected for the National Competitive Program.

3.6 The Organizer does not inform applicants about the reasons for refusing to participate in the Festival’s competitive or other programs.

3.7 The act of submitting an application by a participant confirms their consent to the transfer, collection, processing, use, and storage of their data. Participant’s data are used exclusively by the Organizer or authorized persons, adhering to necessary confidentiality measures, solely in connection with conducting the Festival and are not provided to any third parties for purposes unrelated to the Festival. Regarding all personal data provided by participants, the Organizer or authorized persons will take measures to ensure the security of personal data following the Law of Ukraine’s “On Personal Data Protection”.

3.8. Participants grant the Organizer the right to use information about the project, namely: a brief description of the project (synopsis), frames from the film/posters, teaser/trailer, a list of the creative team of the project, their biographies, and team photos, quotes said by anyone from the team, etc., in the public space (on news resources, websites, social networks, etc.) if the project is selected for showing at the festival (in competitive or non-competitive programs).

IV. FUNDING OF THE FILM FESTIVAL

4.1. Financial provision of the Doc Kyiv Fest film festival is carried out through sources not prohibited by the legislation of Ukraine.

V. FINAL PROVISIONS

5.1. In the event of any disputes arising under this Regulation, they shall be resolved through conscientious and constructive negotiations between the conflicting parties.

5.2. For all matters not regulated by this Regulation, the Organizer shall make separate decisions, about which additional information will be provided.

5.3. The provisions of this Regulation may be supplemented and/or amended at any time, with subsequent publication on the official website, https://www.dockyivfest.com.
