Regulations of Doc Kyiv Fest: Pitching Development

Doc Kyiv Fest is a film festival created to support and develop the art of cinematography and the film industry in Ukraine and present high artistic quality Ukrainian and international films to the audience (hereinafter referred to as the Festival). The founder and organizer of the Festival is the public organization “Kinofest,” registered and operating following the current legislation of Ukraine (hereinafter referred to as the Festival). The Festival takes place in Kyiv, Ukraine, based on these Regulations, and is planned for March 28-30, 2024.
The Doc Kyiv Fest: Pitching Development program includes sections like pitching medium-length documentary films at the development stage.
I. GENERAL PROVISIONS, OBJECTIVES, AND DEFINITIONS
For these Regulations, the following terms and definitions apply:
– Festival: Doc Kyiv Fest, a festival of medium-length documentary cinema.
– Project: a Festival participant, a medium-length film that meets the requirements of the Regulations.
– Medium-length film: a type of film that lasts 20 to 70 minutes.
– Ukrainian film: an audiovisual work of cinematography consisting of episodes united by a creative concept and imaging means, produced entirely or partially in Ukraine or as part of an international co-production with Ukraine.
– Foreign film: an audiovisual work of cinematography produced entirely or partially in countries other than Ukraine.
Doc Kyiv Fest: Pitching Development (hereinafter – Pitching) is a Festival section presenting projects by producers and directors at the “pre-production” stage, intended for theatrical, television, festival distribution, and OTT platform release.
**II. PRESENTATION OF MEDIUM-LENGTH DOCUMENTARY FILM PROJECTS AT THE DEVELOPMENT STAGE**
2.1. Producers and directors of medium-length films at the “pre-production” stage, intended for theatrical, television, festival distribution, and OTT platform release, are invited to participate in the Pitching.
2.2. Projects submitted for consideration must be Ukrainian production or co-production with Ukraine.
2.3. Applications are accepted without any restrictions on age, physical abilities, race, gender, religion, or sexual orientation.
2.3. Project selection criteria:
– The project must be a medium-length documentary (20 to 70 minutes in duration);
– The first draft of the script must be completed at the time of application;
– A director and producer must be attached to the project at the time of application;
– The project must be produced in Ukraine or as a co-production with Ukraine;
– The project must not have been presented on other industrial platforms in Ukraine (except for official State Film Agency of Ukraine pitchings).
2.4. Requirements for documents and materials when submitting a project:
– The application must be filled out according to the Form and Regulations and submitted by the deadline;
– All mandatory fields in the Application must be filled;
– The Application must include a script fragment (up to 10 pages), a synopsis, and an extended synopsis of the project; a director’s vision (1 page); and photos of the director and producer (.jpeg).
2.4.4. A list of additional documents for participation in the session will be sent separately to the pitching participants.
2.5. Requirements for materials and documents of participant projects:
– Official representatives of the selected project must fill out accreditation applications for Doc Kyiv Fest Industry for each project representative (2 persons);
– Video materials for the presentation are submitted in MOV PRORES 422 format with English subtitles;
– Presentation slides of the Project are submitted in JPEG format (1920×1080), each slide as a separate file, and a copy in PDF or PPT format;
– Instructions for preparing materials will also be sent separately to the participants.
2.6. Important dates:
– Applications are accepted from January 9 to February 2, 2024, until 23:59 Kyiv time;
– The list of Pitching participants will be announced on February 19, 2024, at https://www.dockyivfest.com;
– Presentations of projects at the Development stage will take place within the events of the Doc Kyiv Fest Industry section of the Festival from March 28 to 30, 2024.
**III. PUBLIC INFORMATION**
3.1. General information about the Projects, authors, and representatives of the Projects mentioned in the Development presentation application will be published in the Doc Kyiv Fest Industry catalog and on the website https://www.dockyivfest.com.
3.2. Selection of participant projects:
– Projects are selected in two stages: technical and selective;
– Technical selection is passed by participants who have submitted all documents and materials according to the rules specified in these Regulations;
– During the selective stage, the Festival’s Selection Committee forms a list of participant Projects that meet the criteria of quality, and artistic value and have national, international, and commercial
potential;
– The Festival’s Organizing Committee forms the Selection Committee and consists of professional representatives of the film industry.
3.3. Determination of Winning Projects:
– The winners of the Development presentation are determined by a professional Jury formed by the Festival’s Organizing Committee;
– The Jury includes cinematographers, producers, investors, and festival selectors with relevant experience and reputation.
3.4. Presentation rules:
– The Project presentation at the Festival is conducted by demonstrating video material (up to 10 minutes) and an oral presentation of the Project by its creative team in any form (up to 5 minutes);
– Any number of the creative team members can participate in the presentation, but the presence of the producer or director of the project is mandatory;
– Additional video, photo, and audio fragments can also be involved in the oral presentation. Video, audio, and other materials used in the project presentation must be provided to the Festival service by March 12, 2024;
– After the presentation, participants must answer questions from the Jury experts. The total time allocated for questions and answers for each project is up to 10 minutes;
– The presentation languages are English or Ukrainian;
– The participant guarantees that the materials used in the presentation are free from any third-party claims and have been properly obtained. In case of any claims from third parties to the Organizer regarding violating their rights in the context of using these materials, the Participant is obliged to settle such claims on their behalf and at their own expense, without involving the Organizer.
3.5. Awards:
– The Project that meets the Jury’s criteria of quality, artistic value, and has national or international potential will be awarded a prize of 25,000 UAH. The cash award will be paid within 3 months from the announcement of the festival winners. The cash prize is subject to taxation, and payment is made considering the restrictions set by the tax legislation of Ukraine. The recipient is obliged to perform all necessary formalities for receiving the payment.
– The winner will include information in the future film’s credits about their participation and victory in the Doc Kyiv Fest Pitching.
– Other awards from the Festival partners are also possible.
– The award ceremony for the Development winners will take place on March 30, 2024.
– The person submitting an application to participate in the Development presentation within the Festival agrees and accepts all the conditions outlined in each point of these Regulations.
IV. INTELLECTUAL PROPERTY RIGHTS AND GUARANTEES
4.1. Submitting an application based on these Regulations for participation in the Festival’s program events indicates that the applicant:
– Has carefully reviewed and fully understands and accepts the terms of these Regulations, including the requirements for films/projects eligible to participate in the Festival;
– Confirms that they have sufficient authority to submit the application and that this action does not violate any rights and/or legitimate interests of third parties;
– Agrees to grant the Organizer the right to provide access to the film/project to the relevant Jury and selection committee members, and in case of successful selection, to use the provided materials for public demonstration during and for the duration of the Festival;
– Guarantees that neither they nor any other physical or legal entities owning or controlling them are cooperating with companies or individuals subject to any economic, trade sanctions, laws, or decrees enacted by the USA, EU, UN, Switzerland, or any other country;
– Ensures that among the ultimate beneficial owners of the companies, participants of the Project, and creative team, there are no individuals who are citizens of the Russian Federation or have a stake of 10% or more in the common budget, and that there are no individuals subject to or potentially subject to sanctions as defined by the Law of Ukraine “On Sanctions”.
4.2. The applicant who submitted the application and provided materials to the Organizer under these Regulations is solely responsible for any claims, lawsuits, or other demands to them and/or the Organizer in connection with the use of these materials within the Festival, and must immediately compensate the Organizer for any possible expenses that have arisen or may arise in this regard. The Organizer has the right to exclude the film from participation in the Festival if evidence of infringement of copyright and/or other rights of third parties by the applicant is obtained.
4.3. The Organizer guarantees that they will not use the audiovisual works and other materials of individuals who have submitted applications according to these Regulations in ways not provided for.
4.5 The Organizer does not pay for presentations at Doc Kyiv Fest: Development.
4.6 The Organizer does not inform applicants about the reasons for refusal to participate.
4.7. The act of submitting an application by a participant confirms their consent to the transfer, collection, processing, use, and storage of their data. Participant’s data are used exclusively by the Organizer or authorized persons, adhering to necessary confidentiality measures, solely in connection with conducting the Festival and are not provided to any third parties for purposes unrelated to the Festival. Regarding all personal data provided by participants, the Organizer or authorized persons will take measures to ensure the security of personal data following the Law of Ukraine “On Personal Data Protection”.
4.8. Participants grant the Organizer the right to use information about the Project, namely: a brief description of the project (synopsis), frames from the film/posters, teaser/trailer, a list of the creative team of the Project, their biographies, and team photos, quotes said by anyone from the team, etc., in the public space (on news resources, websites, social networks, etc.) if the project is selected for showing at the Festival.
V. FINAL PROVISIONS
5.1. In case of any disputes arising under this Regulation are to be resolved through conscientious and constructive negotiations between the conflicting parties.
5.2. For any issues not regulated by this Regulation, the Organizer at their discretion makes separate decisions, about which they will inform additionally.
5.3. The provisions of this Regulation may be supplemented and/or amended at any time with subsequent publication on the official website https://www.dockyivfest.com.
